Notice at Collection for California Employees and Applicants

This Notice at Collection for California Employees and Applicants (“Privacy Notice”) describes how Self Esteem Brands LLC (“SEB”) collects and uses Personal Information (as such term is defined under applicable privacy law/s) from its job applicants and employees for human resources, employment, benefit administration, health and safety, and business-related purposes and to be in legal compliance.  Below are the categories of Personal Information we collect and the purposes for which we intend to use this information:

  • Demographic data,
    • Applicants: full name, email address, phone number, address is optional
    • Employees: full name, email address, phone number, address, gender, age, birthdate, SSN, Ethnic ID, (voluntary information asked for but not required: disability status, veteran status, work permit, bank information)
  • Contact information, home address, telephone numbers, email addresses, and emergency contact information
  • Dependent’s or other individual’s information, full name, date of birth, and SSN
  • National identifiers, SSN, passport, driver’s license, and visa information, and immigration status and documentation (need passport or 2 additional pieces of ID, with 1 being a photo ID), we also collect citizenship status
  • Educational and professional background,
    • Applicants: Information is provided to us on Resume such as work history, academic and professional qualifications, educational records, references

NOTE: During the interview process SEB writes interview notes that are communicated to hiring manager/interview team.

  • Employees: We do not collect this information
  • Employment details, job title, position, hire dates, compensation, performance and disciplinary records, and vacation and sick leave records
  • Financial information, banking details, tax information, payroll information, and withholdings
  • Health and Safety information
    • Retained in secure confidential folder: health conditions (if relevant to employment), job restrictions, workplace illness and injury information, and health insurance policy information
  • Information Systems (IS) information has the ability to search history, browsing history, login information, and IP addresses on SEB’s information systems and networks
  • Biometric information: photo/s
  • Geolocation data, has the ability to track time and physical location related to use of an internet website, application, device, or physical access to a Company office location
  • Sensory or surveillance information – collected all vaccination cards that are kept in personnel folders on the shared drive under confidential. COVID-19 related vaccination cards

SEB collects this Personal Information referenced above to use or disclose as appropriate to:

  • Comply with applicable laws and regulations
  • Recruit and evaluate job applicants and candidates for employment
  • Conduct background checks. Employee has to sign authorization form
  • Manage employment relationship with SEB, including for:
    • onboarding processes
    • timekeeping, payroll, and expense report administration
    • employee benefits administration
    • employee training and development requirements
    • the creation, maintenance, and security of your online employee accounts
    • reaching your emergency contacts when needed, such as when you are not reachable or are injured or ill
    • workers’ compensation claims management
    • employee job performance, including goals and performance reviews, promotions, discipline, and termination
    • other human resources purposes
  • Manage and monitor employee access to company facilities, equipment, and systems
  • Conduct internal audits and workplace investigations where there is legitimate reason to do so
  • Investigate and enforce compliance with and potential breaches of SEB policies and procedures
  • Engage in corporate transactions requiring review of employee records, such as for evaluating potential mergers and acquisitions of SEB
  • Maintain commercial insurance policies and coverages, including for workers’ compensation and other liability insurance
  • Perform workforce analytics, data analytics, and benchmarking
  • Administer and maintain SEB’s operations, including for safety purposes
  • For marketing purposes
  • Call monitoring and video surveillance as appropriate based on legitimate business interests
  • Exercise or defend the legal rights of SEB and its employees

Disclosure to Third Parties

SEB does not sell, share or otherwise disclose your personal information to third parties for any monetary consideration.  SEB only shares your personal information with service providers to the extent necessary in order to administer employee benefits, including for payment of wages, tax processing, and health insurance, and in connection with its human resource activities.  SEB also discloses your information when required to by local, state, or federal law.

Changes to this Privacy Notice

SEB reserves the right to update this Privacy Notice at any time.  Please check the Privacy Notice periodically for updates.  SEB may use your previously collected Personal Information for different purposes than those it notified you about at the time of collection. However, SEB will provide you with notice and, where required by law, seek your consent, before using your Personal Information for a new purpose.  SEB may process your Personal Information without your knowledge or consent only where required by applicable law or regulation.
